Abstract

La sentencia de la Corte Suprema de 8 mayo de 2017 de manera tangencial examina la prohibición de registro como marca de los símbolos con contenido religioso. Tal decisión nos permitirá revisar qué posición adopta el Derecho comparado sobre esta cuestión. Acto seguido, trataremos de resolver bajo qué criterios normativos es posible denegar la inscripción de tales signos en nuestro país, teniendo a la vista conceptos jurídicos indeterminados, como son el orden público, la moral o las buenas costumbres, que se recogen en la prohibición contenida en el artículo 20 letra k) de la Ley de Propiedad Industrial.
