Interpretación contractual objetiva: entre buena fe y razonabilidad

Abstract

En este artículo se propone que la interpretación subjetiva busca la intenciónconcreta, mientras que la objetiva aquello que un modelo ideal habría acordado. Se sostiene que, sin perjuicio de que la distinción puede ser más bien borrosa, en nuestra tradiciónjurídica prima el modelo subjetivo, pues el objetivo releva cuando no es posible reconstruirla intención. A nivel comparado, los parámetros o modelos objetivos son de diversa índole,pero tienden a identificarse con la persona razonable. En Chile, suele recurrirse a la buena fe, pero esto no comporta una diferencia sustantiva, pues se ha producido una suerte desimbiosis entre los conceptos razonabilidad y buena fe.
