De nuevo las subvenciones y ayudas agrícolas ante el Tribunal Constitucional

Abstract

Este artículo analiza la Sentencia del Tribunal Constitucional 99/2012, que resuelve un conflicto de competencias entre el Estado y Castilla-La Mancha en relación con el Real Decreto 117/2001, referente a subvenciones y ayudas agrícolas. La Junta de Comunidades cuestionó la normativa estatal por supuestamente invadir competencias autonómicas en agricultura y ganadería. El Tribunal Constitucional concluyó que, aunque el Estado puede establecer criterios básicos de planificación económica, debe respetar el margen de acción autonómico. La sentencia también aborda cuestiones procedimentales, como las convocatorias únicas y la publicación de las resoluciones, ratificando su constitucionalidad en el marco de la Ley General de Subvenciones.
