Abstract

Debemos partir de la consideración de que el albedrío del profesional sanitario es imprescindible para un ejercicio responsable de la práctica asistencial, que tenga su base en la libertad y la imprescindible independencia de juicio, puesto que no hay vida moral sin libertad, ni responsabilidad sin independencia. La naturaleza jurídico-constitucional de la objeción de conciencia sanitaria es la de un derecho fundamental, que forma parte del contenido esencial de las libertades del artículo 16 de la Constitución (libertad ideológica y religiosa) y, más en concreto, de la libertad de conciencia, como núcleo común de ambas libertades. En ausencia de regulación legal sobre objeción de conciencia sanitaria, la eficacia constitucional directa de los derechos fundamentales debiera traducirse en una protección suficiente y efectiva del derecho de objeción de conciencia sanitaria. Sin embargo, no es esta la realidad, no percibiéndose con claridad en los medios jurídicos, lo que sigue generando en estos momentos gran inseguridad.
