Abstract

Este libro de Fritz Schreier constituye uno de los ensayos más interesantes sobre Teoría Fundamental del Derecho.Para pesar debidamente la significación de la obra de Fritz Schreier antiguo profesor en la Universidad de Viena, y expatriado como todos sus maestros y colegas hay que recordar en quiénes se inspira. Pues Schreier es a la vez discípulo de Hans Kelsen el constructor de la “teoría pura del Derecho” de raíz neokantiana, y de Edmund Husserl el genial descubridor de la fenomenología. Y se inspira a la vez en ambos.Mucho se ha atacado a Schreier por su propósito de maridaje entre la teoría pura del Derecho de Kelsen y la fenomenología de Husserl. Se ha dicho que la unión entre estas dos obras es algo imposible; y que, de intentarse, ha de dar como resultado un producto monstruoso y contradictorio. Y esta crítica se ha fundado en la consideración de que la fenomenología es incompatible con la filosofía neokantiana; precisamente, porque la fenomenología representa en muchas de sus partes una crítica y una esencial rectificación frente al neokantismo. Sin embargo, no estimo justa esa objeción de propósito radicalmente demoledor, que ha actuado como prejuicio que ha cerrado en absoluto a sus formuladores toda comprensión para la obra de Schreier, hasta el punto de que no pudieron enterarse ni remotamente del espíritu que la anima, ni de sus resultados.(De la Prólogo de la obra)
