Delimitación entre el dolo eventual e imprudencia

Abstract

La delimitación entre el dolo eventual e imprudencia ha devenido en un problema debido a que las diferentes teorías que han tratado de conceptualizar ambas categorías las han identificado con datos físicos, psíquicos y empíricos, lo cual no ha hecho posible una distinción clara a nivel conceptual; y ello ha repercutido directamente sobre su delimitación.Marc o Bustinza, hace un adecuado planteamiento del problema, desarrolla una elaborada hipótesis de trabajo, analiza en una apretada síntesis, como producto de la aplicación del método deductivo-documental aplicado a las teorías reseñadas, cómo la doctrina entiende los términos voluntad y conocimiento. Para luego explicar su toma de postura respecto a los conceptos de dolo e imprudencia y su aplicación práctica. Todo ello con un notable y moderno soporte bibliográfico.
