Abstract

O presente parecer jurídico propõe-se a investigar, criticamente, o Projeto de Lei Complementar nº 29/2013, que institui a Lei de Parcelamento do Solo Urbano do Município do Rio de Janeiro, assinalando-lhe imprecisões teóricas, bem assim, sugerindo inclusões, modificações e supressões no texto original. Este trabalho analisa os principais dispositivos do referido projeto de lei complementar, de forma sistemática, ao lume da ordem jurídico-urbanística enformada pelo Plano Diretor de Desenvolvimento Urbano Sustentável do Município do Rio de Janeiro (Lei Complementar nº 111/2011), pela Lei Orgânica do Município do Rio de Janeiro, pela Lei Federal do Parcelamento do Solo Urbano (Lei Federal nº 6.766/1979), pelo Estatuto da Cidade (Lei Federal nº 10.257/2001) e, sobretudo, pela Constituição Federal de 1988. Por fim, em documento anexo, apresenta-se uma proposta de substitutivo para o projeto, visando a corrigir suas impropriedades científicas e a colmatar suas lacunas.
