Derechos de la naturaleza y derechos a la naturaleza: tendencias emergentes en el derecho internacional

Abstract

Desde la década del 2000, ha habido un creciente reconocimiento de los derechos de la naturaleza a nivel nacional. Si bien está aumentando el número de ejemplos nacionales sobre los derechos de la naturaleza, son pocos los desarrollos legales en el ámbito internacional. Las leyes y jurisdicciones nacionales están presionando para transformar la naturaleza, de modo que pase de ser un “objeto” de regulación a ser un actor en sí, dotado de personalidad jurídica. Esta creciente práctica ha influenciado el surgimiento de un nuevo enfoque en el derecho internacional que considera que la naturaleza debe protegerse por derecho propio. Este artículo adopta un enfoque de derecho comparado para examinar las principales características y límites del reconocimiento de los derechos de la naturaleza en algunas jurisdicciones nacionales y se centra en tres características clave, a saber: la personalidad jurídica de la naturaleza, el nombramiento de guardianes y la legitimidad en la causa ante tribunales nacionales. La segunda parte se enfoca en la dimensión internacional de los derechos de la naturaleza, y analiza las sinergias y posibles tensiones entre los derechos de la naturaleza y los derechos a la naturaleza, es decir, el derecho humano a un medioambiente sano, teniendo en cuenta algunos instrumentos internacionales y la jurisprudencia de la Corte Interamericana de Derechos Humanos.
