ملخص ان المخاطر الاجتماعية هي بطبيعتها مخاطر اقتصادية تؤثر على موارد الأفراد و نفقاتهم، يتعرض لها جميع الأفراد. ويعتبر أضعف الأفراد واكثرهم تعرضاً للمخاطر الاجتماعية : المسنون، ذوي الاحتياجات الخاصة، النساء ، الأطفال ، الأقليات والمهاجرون. في هذا السياق ، الحماية الاجتماعية تشمل "جميع التدابير التي يتخذها مختلف الفاعلين الحكوميين و الغير الحكوميين في اطار حماية الأفراد من المخاطر الاجتماعية التي تسببت في انخفاض في الدخل أو زيادة في النفقات ". يقدم هذا المقال دراسة علمية للإطار القانوني المغربي المنظم للحماية الاجتماعية تستند على فكرة أن الحماية الاجتماعية هي عملية تدبيرية تخضع للنظريات العلمية التي لها علاقة بمجال التدبير. تستند المنهجية المعتمدة في هذا السياق على ثلاث منهجيات متكاملة فيما بينها: دراسة وثائقية وتحليلية واستنباطية. يهدف هذا المقال الى دراسة مختلف القوانين المنظمة للحماية الاجتماعية بالمغرب واقتراح منظومة قانونية على ضوء الدراسات السابقة. للتمكن من تحقيق أهداف هذه الدراسة، يعرض هذا المقال في ثلاث محاور مختلف النتائج التي تم التوصل اليها: المحور الأول يتطرق الى دراسة الإطار القانوني للحماية الاجتماعية في مرحلتها الأولى ما قبل تعميم التغطية الاجتماعية بالمغرب، والذي يتمحور حول التغطية الصحية؛ نظام المعاشات؛ الدعم الاجتماعي والرعاية الاجتماعية. المحور الثاني من المقال يتطرق الى دراسة الإطار القانوني المتعلق بتنزيل مشروع تعميم التغطية الاجتماعية بالمغرب، والذي يتضمن بدوره اجراءات تعميم الحماية الاجتماعية والدعم الاجتماعي. أما بالنسبة للمحور الثالث فقد تم تخصيصه للمنظومة القانونية المقترحة التي تضمن نجاعة منظومة الحماية الاجتماعية بالمغرب على ضوء الدراسات السابقة. Abstract By their nature, social risks are economic risks affecting the resources and expenses of individuals, to which all individuals are exposed. Older persons, with special needs, women, children, minorities and migrants are the most vulnerable and socially vulnerable. In this context, social protection covers "all measures taken by various governmental and non-governmental actors in protecting individuals from social risks that have caused a decrease in income or an increase in expenditure." This article presents a scientific study of the Moroccan legal framework governing social protection based on the idea that social protection is a management process subject to scientific theories relating to the field of management. The methodology adopted in this context is based on three complementary methodologies: Documentary, analytical and discretionary study. This article aims to examine the various laws regulating social protection in Morocco and to propose a legal system in the light of previous studies. In order to achieve the objectives of this study, this article is presented in three main areas: The first relates to the study of the legal framework for social protection in the first phase of the pre-universal social coverage in Morocco, which focuses on health coverage; Pension system; social support and welfare . The second focus of the article deals with the study of the legal framework for downloading the social coverage project in Morocco, which in turn includes the procedures for mainstreaming social protection and social support. The third focus has been devoted to the proposed legal system that ensures the effectiveness of Morocco's social protection system in the light of previous studies.
