
Los objetivos de mi comentario son dos. Primero, poner de relieve que, además de las concepciones persuasiva y cognoscitivista de la prueba que distingue Taruffo, cabe identificar una tercera concepción que, a los fines de racionalidad de la decisión judicial, se aproxima a la persuasiva y/o resulta tan perniciosa como ésta. Segundo, que esa aproximación se refleja sobre todo en el plano de la motivación: en ambos casos se produce una rebaja –cuando no una elusión total- en las exigencias de justificación.
