Abstract

Este trabajo ha sido seleccionado y obtenido el Accésit Premio Estudios Financieros 2002 en la Modalidad de Tributación. El año 1997 se presentó como un año clave para el futuro económico-social español. Los Presupuestos de 1997 fueron enormemente restrictivos, había un objetivo prioritario, la entrada en la siguiente fase de la Unión Económica y Monetaria y para eso había que cumplir unos requisitos de déficit público, de deuda. En este marco comienza un conflicto, el Gobierno decide congelar los salarios a los funcionarios e incumplir un acuerdo alcanzado en 1994 sobre subida salarial. Inmediatamente comienza la batalla y los sindicatos deciden recurrir dicha decisión. De todos es conocida la Sentencia dictada por la Audiencia Nacional de 7 de noviembre de 2000, relativa a la congelación salarial de los funcionarios públicos en 1997 (anulando dicha congelación salarial). También es conocida por todos la Sentencia del Tribunal Supremo de 27 de febrero de 2002, cuya Sala de lo Contencioso acordó dejar sin efecto y anular la Sentencia anterior. En este trabajo analizaremos todos los problemas que surgen a raíz de estas dos sentencias, nos adentraremos otra vez en el complicado y eterno mundo de la naturaleza jurídica de la Ley de Presupuestos, analizaremos el principio de legalidad presupuestaria, las obligaciones económicas del Estado, y hasta dónde llega su responsabilidad.
