Abstract

À partir de situations françaises, nous nous interrogeons sur la place du système pastoral dans le territoire et dans le droit à travers ce qui définit le « foncier pastoral ». Comment ce foncier est-il traité, à travers l'histoire, par le droit positif ? De quelle manière les politiques publiques prennent-elles en compte ce droit sur le fonds préposé au pastoralisme ? Ces interrogations aboutissent à un constat. Aller plus loin consiste à s’intéresser au régime du foncier pastoral et à sa mise en œuvre alliant relation de propriété et relation de territorialité. En effet, la façon dont le droit se saisit de l’espace pastoral permet de se poser la question du régime foncier (le rapport juridique à la terre) face à celle de l’identité territoriale (ce qui fait territoire). Le paradigme qui sous-tend chacune d’elle n’est pas toujours le même d'où des tensions voire des confrontations entre ces deux rapports au foncier. La prise en compte à la fois de la réalité du régime de propriété foncière et de celle de la « mise en territoire » du système pastoral débouche sur une transversalité entre les deux paradigmes qui se pose particulièrement depuis l’inscription au patrimoine mondial de l’UNESCO du site Causses-Cévennes pour ses paysages agropastoraux. Le passage à l’échelle locale du caractère patrimonial ne se décrète pas et cette inscription se présente comme une occasion pour les acteurs locaux de formaliser des valeurs territoriales autour du pastoralisme. Aussi, des innovations endogènes au territoire sont récemment promues par ces acteurs dans un processus d’expérimentation au sein de la Communauté de Communes « Causses Aigoual Cévennes Terres solidaires ». L’enjeu est de mettre en lumière la pluralité des rapports à la terre, propriété individuelle ou territoire commun, la marge des possibles qui ne se limite pas à l’ontologie de l’appropriation.
