Abstract

Razmatrajući odluku Ustavnog suda RH od 12. svibnja 1998. godine kojom je Ustavni sud ukinuo članke 1., 2., 3., 4. i 6. Zakona o usklađivanju mirovina i drugih novčanih primanja iz mirovinskog i invalidskog osiguranja, te upravljanju fondovima mirovinskog i invalidskog osiguranja (Narodne novine br. 20/1997.), u daljem tekstu - Zakon o usklađivanju, autor pristupa analizi nekih odrednica Hrvatske kao socijalne države. U tom kontekstu ističe se da hrvatski Ustav unaprijed ne određuje sadržaj koncepta socijalne države (čl. 1.) i načela socijalne pravde (čl. 3.). Konkretizacija tih načela ostavljena je zakonodavcu, a ne sudbenoj niti ustavno-sudbenoj vlasti. Međutim, zakonodavac je u svojoj konkretizaciji ograničen načelom socijalne države i socijalne pravde čije granice određuje Ustavni sud. Ustavni sud ne može konkretizirati subjektivna socijalna prava, ali može ocjenjivati sukladnost zakona s načelom socijalne države i drugim temeljnim vrijednostima ustavnog poretka. U tom kontekstu potrebno je razlikovati interpretaciju Ustava u skladu s načelom socijalne države i načelom socijalne pravde od stvaranja i zaštite subjektivnih prava. Međutim, neosporno je da interpretacija Ustava i zakona, uključujući i apstraktna temeljna načela, spada u ustavnosudski djelokrug. Širi problem vezan uz problematiku ustavnosudske zaštite socijalnih prava je u tome što rješavajući jednu posve ograničenu pravnu situaciju Ustavni sud nije u mogućnosti uzeti u obzir složeno gradivo socijalne države, odnosno, odlukom Ustavnog suda nije moguće uvažiti interese onih koji bi trebali sudjelovati u političkom procesu i biti stranke socijalnog sporazuma.

The author discusses the decision of the Constitutional Court of the Republic of Croatia of May 12, 1998 and analyses some characteristics of the Croatian welfare state. The Croatian Constitution does not prescribe any particular concept of a welfare state and social justice. Concretisation of these principles is left to the legislative and not to the judicial branch. However, the legislator is restricted by the aforementioned principle boundaries, to the defined by the Constitutional Court. The Constitutional Court cannot legislate subjective social rights but is authorised to review the compatibility of laws with the constitutional principles of a welfare state and with other fundamental values of the Croatian constitutional order. In this context, one should distinguish the constitutional interpretation in accordance with the principles of a welfare state and social justice from the creation and protection of individual rights. It is beyond any dispute that such interpretation falls within the proper province of constitutional juridiction. A much broader issue related to the constitutional review of social rights lies in the fact that, when deciding in an isolated legal situation, the Constitutional Court is not in the position to consider the complex fabric of a welfare state. In other words, the Constitutional Court is not the proper forum to meet the legitimate interests of possible participants in a social compact which should not result from a judicial decision but from a political process.
