Les conflits et la vie dialectique selon Hegel : conflit juridique, conflit historique et conflit hiérohistorique (1807-1821)

Abstract

Le probleme du conflit, de la conflictualite du rapport entre les cons ciences est celui des pages les plus celebres de la Pbenomenologie de fesprit consacrees a la dialectique du maitre et du serviteur. Mais le conflit n'est pas seulement celui du rapport de domination a servitude; il est aussi le conflit tragique, present dans FEsprit de la Cite grecque comme dans la Religion esthetique1. II y a done une precellence du conflit tragique sur le conflit pour la reconnaissance, dans la mesure ou le conflit tragique assume la realite de FEsprit, sous sa forme historico-ethique comme sous sa forme esthetico religieuse. Mais le conflit n'est pas pour Hegel Fessence du politique, lequel est pense de fa$on organique (et ou les tensions se resolvent d'une fa?on myste rieuse); c'est la guerre entre Etats qui est, au moins en premiere lecture, la seule modalite conflictuelle de la Philosophie du droit. C'est done au niveau de Fhistoire des peuples, et non pas au niveau de Fhistoire de la conscience de soi, que le conflit retrouve une place centrale.
