
Le droit à l’image fait peser des contraintes de plus en plus importantes sur les pratiques photographiques de terrain et contribue à une certaine conformation esthétique de la photographie documentaire. Les chercheurs photographes jonglent souvent avec deux injonctions à l’anonymat, celle des sciences sociales garantissant traditionnellement aux personnes enquêtées la dissimulation de leur identité, et celle liée au respect du droit à l’image. Les procédures textuelles d’anonymisation se combinent alors dans l’écriture scientifique avec des procédés plastiques (floutage, cadrages spécifiques, évacuation des sujets vivants etc.) La demande d’autorisation, présentée comme nécessaire dans la perspective d’une publicisation des images, n’est pourtant pas toujours possible, ni même forcément compatible avec les enjeux de la recherche. L’interprétation du droit à l’image soulève des questions méthodologiques et épistémologiques. Cet article propose une contribution à la réflexion sur la sociologie et l’anthropologie par l’image à partir de l’étude des effets de ces contraintes juridiques sur les postures scientifiques.
