Abstract

A compreensão do Estado encontra ainda hoje nas reflexões de Max Weber sobre o tema o seu ponto de partida porventura mais profícuo. Weber definia o Estado como uma «organização institucional política» cujo «quadro administrativo pode exercer com sucesso o monopólio da força física legítima na execução das suas ordens». Esta definição suscita, desde logo, três considerações. Em primeiro lugar, embora não haja dúvida que o critério do monopólio da força física ocupa em tal definição o lugar preponderante, a mesma não se reduz a ele, importando ainda atentar nos critérios do carácter político, institucional, e organizacional do Estado, e ainda no critério da legitimidade do exercício da força física. Em segundo lugar, a definição em causa distingue-se por abstrair de qualquer dimensão substantiva do Estado e pela sua renúncia a qualquer tentativa de definição baseada nos fins e propósitos do Estado. Em terceiro lugar, é ainda necessário salientar a afinidade metodológica subjacente à definição proposta por Max Weber com a desenvolvida por Georg Jellinek na sua teoria do Estado.
