Abstract

W niniejszym artykule problem kredytów frankowych został przedstawiony z dwóch perspektyw. Po pierwsze, instytucji klauzul niedozwolonych, po drugie, orzecznictwa Sądu Najwyższego. Innymi słowy, w opracowaniu dokonano analizy jak każda z przesłanek uznania postanowienia za abuzywne, w kontekście umów kredytów frankowych i zawartych w nich klauzul waloryzacyjnych, jest interpretowana przez Sąd Najwyższy. Rozważono również, czy uznanie klauzul waloryzacyjnych za abuzywne może prowadzić do nieważności umowy kredytu frankowego, a jeżeli tak, jakie są tego konsekwencje.

The article presents the problem of mortgage loans denominated in Swiss francs from two perspectives. First, the perspective of unfair terms, and secondly - the Polish Supreme Court judgments. In other words, it has been analysed what is the position of the Supreme Court with reference to each of the unfair terms criteria in the context of such loans. It has also been considered whether finding an indexing clause abusive may lead to the annulment of a contract, and, if yes, what are the consequences of such annulment.
