¿Una nueva responsabilidad por productos defectuosos?

Abstract

Desde hace años, es lugar común en la doctrina reivindicar la reforma del régimen de responsabilidad civil por productos defectuosos. La Unión Europea, tras años de trabajo en ese sentido, ha propuesto una nueva Directiva que sustituye la de 25 de julio de 1985 actualmente vigente. En el trabajo se analizan críticamente los cambios introducidos en esta Propuesta que afectan prácticamente a todos los elementos de la responsabilidad: sujetos responsables, concepto de producto y de defecto, relación de causalidad, daños indemnizables y causas de exoneración. Y, sobre todo, el objetivo de estas líneas es valorar cuáles de esas modificaciones cumplen la finalidad de adaptar las normas de responsabilidad civil por productos a los daños que, fruto de la inteligencia artificial, de la robótica y del Internet de las cosas, pueden presentarse en la sociedad actual y cuáles, por el contrario, deberían todavía ser repensadas para mejorar el texto que finalmente resulte aprobado.
