
Abstract In accordance with Article 6 of Regulation (EC) No 396/2005, Austria, herewith referred as the evaluating Member State (EMS), received an application from Makhteshim Agan to modify the existing MRL for folpet in wine grapes. In order to accommodate for the intended use of folpet, Austria proposed to raise the existing MRL from the value of 5 mg/kg to 8 mg/kg. Austria drafted an evaluation report according to Article 8 of Regulation (EC) No 396/2005, which was submitted to the European Commission and forwarded to EFSA. The submitted data are sufficient to derive a MRL proposal for folpet on wine grapes. Applying the agreed statistical methodology a MRL proposal of 10 mg/kg is derived. Should the enforcement residue definition be revised to take into account the metabolite phthalimide, the MRL needs to be set at the level of 20 mg/kg. Adequate analytical enforcement methods are available to control residues of folpet in the commodity under consideration at the LOQ of 0.05 mg/kg. For phthalimide the analytical methods were successfully validated at an LOQ of 0.2 mg/kg. EFSA concludes that the intended use of folpet on wine grapes is not likely to lead to a consumer exposure exceeding the toxicological reference values and therefore is not expected to pose a public health concern.
