Abstract

La Ley Orgánica de Mejora de la Calidad de la Educación (LOMCE) introdujo el derecho de los representantes legales de los menores en que sus hijos o pupilos reciban enseñanza en castellano en aquellas comunidades autónomas (CCAA) con más de una lengua oficial, que ha sido desarrollado reglamentariamente en el RD 591/2014. Ambas normas forman parte de una estrategia de determinados sectores políticos para construir este derecho, después de haber intentado infructuosamente su reconocimiento por parte de la doctrina constitucional. Con todo, los cambios jurisprudenciales operados con la STC 31/2010, que han intensificado la exigencia de un trato de igualdad radical del castellano en relación en el resto de lenguas cooficiales han espoleado nuevas interpretaciones sobre la constitucionalidad de los vigentes regímenes lingüísticos en diversos ámbitos, también el educativo. Ahora y tanto, a la espera del pronunciamiento del Tribunal Constitucional sobre la cuestión, determinados preceptos de la LOMCE y de sus normas de desarrollo constituyen una fractura del orden constitucional y estatutario vigente en materias como|cómo el régimen lingüístico y las competencias educativas en Cataluña.

The Implementing Law for the Improvement of Educational Quality (LOMCE) introduced the right for legal representatives of minors to have their children or wards taught in Spanish in those autonomous communities having more than one official language. This right was fleshed out regulatorily through RD 591/2014. Both laws are part of a strategy by certain political sectors to construct this branch of law, after having unsuccessfully tried to have it recognized by constitutional scholars. All in all, the changes in the case law that have taken place with Constitutional Court Judgement 31/2010, which have intensified the demand for strictly equal treatment for Spanish with respect to the rest of the co-official languages, have sparked new interpretations of the constitutionality of language rules in various spheres, including that of education. Now, in anticipation of the ruling by the Constitutional Court on the issue, certain provisions of the LOMCE and its enabling regulations constitute a divide in the constitutional and statutory principles that are currently in force in areas such as the language system and the distribution of powers in the Catalan educational system.

La Llei orgànica de millora de la qualitat de l’educació (LOMCE) va introduir el dret dels representants legals dels menors a què els seus fills o pupils rebin ensenyament en castellà en aquelles comunitats autònomes (CCAA) amb més d’una llengua oficial, que ha estat desenvolupat reglamentàriament en el RD 591/2014. Ambdues normes formen part d’una estratègia de determinats sectors polítics per a construir aquest dret, després d’haver intentat infructuosament que la doctrina constitucional el reconegui. Amb tot, els canvis jurisprudencials que s'han dut a terme amb la STC 31/2010 han intensificat l’exigència d’un tracte de plena igualtat del castellà en relació amb la resta de llengües cooficials han generat noves interpretacions sobre la constitucionalitat dels règims lingüístics vigents en diversos àmbits, també l’educatiu. A l’espera del pronunciament del Tribunal Constitucional sobre la qüestió, determinats preceptes de la LOMCE i de les seves normes de desenvolupament constitueixen una fractura de l’ordre constitucional i estatutari vigent en matèries com el règim lingüístic i les competències educatives a Catalunya.
