Abstract

La asistencia medica que se presta en los balnearios espanoles, al igual que otras facetas y ambitos de la Medicina, esta sometida a unos aspectos deontologicos, eticos y legales, que en unas ocasiones afectara a las acciones llevadas a cabo por los profesionales sanitarios de los centros, y en otras a las relaciones de los facultativos con los aguistas que acuden a efectuar la cura termal. Desde el punto de vista puramente legal y emanando directamente de la Constitucion de 1978, deben contemplarse diversas normativas como la Ley 14/1986 de 25 de abril, General de Sanidad, Ley Organica 15/1999, de 13 de diciembre, de Proteccion de Datos de Caracter Personal ( Datos de caracter personal, Seguridad de los Datos, Derechos ARCO), Ley 41/2002 de 14 de noviembre, basica reguladora de la autonomia del paciente y de derechos y obligaciones en materia de informacion y documentacion clinica (informacion, consentimiento informado, historia clinica) y, la Ley 44/2003, de 21 de noviembre, de Ordenacion de Profesiones Sanitarias (libertad de prescripcion), sin olvidar los aspectos deontologicos y bioeticos que deben regir una asistencia sanitaria de excelencia como indica la normativa espanola.
