Abstract

Diversos estudios doctrinarios se han realizado respecto a los aspectos procesales más puros de la sentencia. Pocos de ellos, en cambio, se han detenido a examinar con relativa minuciosidad un elemento clave en la decisión judicial: la convicción psicológica del juez. Nos centramos en una primera instancia, sobre los aspectos procesales que componen a la sentencia, como sus elementos, su naturaleza, la valoración de la prueba y los principios que la delimitan; llegando en último término al juicio lógico en propiedad. Desde un punto de vista sustancial, transitamos por diferentes elementos relacionados íntimamente con la convicción del juez y sus limitaciones, como la imparcialidad, la discrecionalidad y la valoración al dictar sentencia. A través de diversas reflexiones y análisis jurisprudencial, así como de un breve estudio comparativo respecto al derecho anglosajón, llegaremos a demostrar que la utilidad que le reputa a nuestro sistema la subjetividad judicial, es indudablemente apreciable. Contemplamos, asimismo, a lo largo del trabajo, potenciales mecanismos que podrían ejercer un control sobre este elemento tan abstracto, llevándolo a cumplir su función fundamental: hacer justicia.
