Abstract

[Excerto] Dispõe o artigo 64º da Constituição da República Portuguesa (CRP) que “todos têm direito à proteção da saúde e o dever de a defender e promover” e, ainda, que tal direito é realizado quer “através de um serviço nacional de saúde universal e geral e, tendo em conta as condições económicas e sociais dos cidadãos, tendencialmente gratuito”, quer “pela criação de condições económicas, sociais, culturais e ambientais que garantam, designadamente, a proteção da infância, da juventude e da velhice, e pela melhoria sistemática das condições de vida e de trabalho, bem como pela promoção da cultura física e desportiva, escolar e popular, e, ainda, pelo desenvolvimento da educação sanitária do povo e de práticas de vida saudável”. O nº 3 do mesmo preceito, utilizando a expressão “garantir” – e não qualquer outra menos intensa – estabelece que, para assegurar aquele direito, “incumbe, prioritariamente, ao Estado que todos os cidadãos, independentemente da sua condição económica, tenham acesso a cuidados da medicina preventiva, curativa e de reabilitação” e que “os recursos humanos e unidades de saúde devem ter uma racional e eficiente cobertura de todo o país”.
