
La nueva ley concursal chilena, N°20.720 (D.O. de 9 de enero de 2014),omite referirse expresamente a los créditos de la primera clase en el procedimientode reorganización judicial de la empresa deudora. Tal omisiónha sido entendida por un sector de la doctrina e incluso por la Superintendenciade Insolvencia y Reemprendimiento como sinónimo de exclusión dedichos créditos, que por lo mismo no serían “reorganizables”.Este trabajo apunta a plantear y justificar la conclusión contraria, con mirasa superar una de las principales trabas que enfrenta actualmente dicho procedimiento,en su esfera de implementación práctica y de cara a su viabilidadeconómica para el deudor proponente.Los métodos de investigación utilizados son los propios de las cienciassociales, en particular, los métodos histórico, dogmático y comparativo.El primero resulta relevante para la revisión de las distintas modalidadesy matices con que ha sido abordada e implementada esta materia en elderecho concursal chileno. El segundo, apunta a la búsqueda, sistematizacióny análisis del material bibliográfico nacional y extranjero sobre lamateria, con miras a construir una visión crítica de la legislación nacionalen materia de reorganización, clases y categorías de acreedores. En eltercero, se confronta el sistema chileno con ordenamientos jurídicos extranjerosque se ocupan de esta materia, analizando las diferencias y semejanzasque existen entre ellos.The first class of credits in the concursal procedure of judicialreorganization in Chile: the great absent?The new Chilean bankruptcy law, No. 20,720 (D.O. of January 9, 2014), omitsexpressly referring to the credits of the first class in the judicial reorganizationprocedure of the debtor company. This omission has been understoodby a sector of the doctrine and even by the Superintendence of Insolvencyand Re-entrepreneurship as synonymous with the exclusion of said credits,which therefore would not be “reorganizable”.This work aims to raise and justify the opposite conclusion, with a view to overcomingone of the main obstacles that is currently facing this procedure, in its sphereof practical implementation and in view of its economic viability for the proponentdebtor.The research methods used are those of the social sciences, in particular, the historical,dogmatic and comparative methods.The first one is relevant for the review of the different modalities and nuances withwhich this subject has been approached and implemented in the Chilean BankruptcyLaw.
