Abstract

Portuguese Abstract: IDesde a construcao da Usina Hidreletrica Itaipu Binacional, no Rio Parana, fronteira entre Paraguai e Brasil, verificou-se a necessidade de construir uma identidade juridica para esta empresa suis generis, que pudesse atender as suas especificidades e tambem garantir estabilidade para as relacoes juridicas decorrentes de seu funcionamento. Um aspecto que sempre obteve destaque diz respeito ao espaco territorial ocupado pela usina. A questao defendida por juristas de renome e sustentada pela propria assessoria juridica de Itaipu e a de que trata-se de um territorio internacional, chamado “territorio de Itaipu”, no qual a soberania dos Estados Parte e limitada, por meio da cessao pelo Tratado de Itaipu da ocupacao e controle desta area. O “territorio de Itaipu” ganha maior relevância no caso brasileiro devido a sua interface direta com a protecao ou degradacao ambiental, e a existencia de principios e normas constitucionais surgidas no Brasil apenas apos o inicio da operacao da usina. O presente artigo procura discutir esta questao com base no Direito Internacional, visando compreender os argumentos em defesa do “territorio de Itaipu” a partir de fundamentos teoricos tradicionais sobre o territorio e sua relacao com a soberania estatal. English Abstract: Since the construction of the Itaipu Binacional Hydroelectric Power Plant, on the Parana River, on the border between Paraguay and Brazil, there has been a need to build a legal identity for this unique company. It should meet its specificities and also guarantee stability for the resulting legal relationships from its operation. One aspect that has always stood out concerns the territorial space occupied by the plant. The thesis defended by renowned scholars and defended by Itaipu's lawyers is that it is an international territory, called “Itaipu territory”. In this territory the sovereignty of States Parties is limited, due to the cession of its occupation and controle by the signature of the Itaipu’s Treaty. The “territory of Itaipu” gains greater relevance in the Brazilian case due to its direct interface with environmental protection or degradation, and the existence of constitutional principles and standards that emerged in Brazil only after the plant started operating. This introductory paper aims to discuss this case based on international law, in order to understand the arguments in defense of the “territory of Itaipu” from traditional theoretical foundations about the territory and its relationship with state sovereignty.
