Abstract

Spanish Abstract: Los usuarios suben a la red infinidad de contenidos generalmente sin conocer o incluso sin importarles si infringen el derecho exclusivo del titular de la obra. El mecanismo de deteccion y retirada de contenidos que vulneren los derechos de propiedad intelectual es un instrumento eficaz para que el titular de la obra obtenga la tutela del bien protegido y, al mismo tiempo, el intermediario quede exonerado de responsabilidad por la infraccion cometida por el tercero. Ahora bien — intermediario y usuario — deben actuar con debida diligencia. La ausencia de un mecanismo comun de notificacion y retirada de contenidos a todos los Estados miembros dificulta este cometido. Uno de los principales desafios a los que, sin lugar a dudas, se enfrenta el legislador europeo es el de como tutelar de forma efectiva los intereses de cada uno de los sujetos implicados. Por ello se opta por elaborar un codigo de buenas practicas con el objeto de agilizar la localizacion y la retirada de contenidos que vulneren derechos de autor e incrementar asi su nivel de proteccion, con base en el articulo 16 de la Directiva sobre el Comercio Electronico, que fomenta e incentiva la autorregulacion. English Abstract: Most of the times users upload to the network without knowing or any concern that they might be infringing the exclusive right of the owner of the work. The mechanism for detecting and removing content that infringes intellectual property rights is an effective instrument for the owner of the work to seek protection of the protected good and, at the same time, the intermediary is exempted from liability for the infringement committed by a third party. Now, both must be diligent in their performance. The lack of a common notice and takedown mechanism for all Member States makes this task difficult. One of the main challenges that the European legislator undoubtedly faces is how to properly protect the interests of each of the subjects involved in this area. This is precisely why it is opted to develop a code of best practices with the aim of speeding up the localization and withdrawal of any infringement of copyright and thus duly increase the protection of each of the subjects involved in this area, based on Article 16 of the Electronic Commerce Directive, which encourages and boosts self-regulation.
