Abstract

Espanol Resumen: En este articulo se abordan algunos de los fundamentos que se dan en los paises latinoamericanos y el mundo sobre el reconocimiento de los denominados derechos reproductivos y sexuales, se revisan en detalle las teorias de genero y su impacto especifico en materia de familia. Ademas, se examina como ejemplo en Chile, las Normas Nacionales de Fertilidad dictadas por el Ministerio de Salud que autorizan la entrega gratuita de la “pildora del dia despues”, documento que es receptor indiscutido de las teorias de genero y que ha sido constantemente objetado. Finalmente, se analiza criticamente el tema y se concluye que centrar la mirada juridica enlos derechos individuales produce una colision de derechos, por lo que se propone una solucion que solo puede provenir de una mirada al bien comun de la familia, y para ello es necesario dictar normas que propendan al fortalecimiento de la familia matrimonial. English Abstract: This article approaches some of the basis given in the Latin American countries and the world about the recognition of the denominated reproductive and sexual rights, it reviews in detail the gender theories and their specific impact in family issues. Also, it examines as example in Chile, the National Fertility Norms dictated by Ministry of Health that authorize the free delivery of the “morning-after pill”, document that is undisputed receiver of the gender theories and that it has been constantly contested. Finally, it analyzes critically the subject and concludes that focus the legal vision in the individual rights produces a collision of rights, consequently it proposes a solution that only can come from a look to family common good, and for that it is necessary dictate norms that promote to the matrimonial family’s strengthening.
