Romanian Abstract: In prezentul articol am abordat instituția erorii-viciu de consimțamânt pornind de la recentele realitați juridice româneșți, in primul rând intrarea in vigoare a noului Cod civil român, apoi tendințele jurisprudentiale și doctrinare in materie.Am tratat clasificarea diferitelor tipuri de eroare, apoi am abordat condițiile pe care trebuie sa le indeplineasca o anumita realitate de fapt concreta pentru a fi calificata juridic conform noilor realitați normative ca fiind eroare-viciu de consimțamânt. Apoi am analizat cazurile de eroare viciu de consimțamânt expres reglementate de lege. In fine, am analizat consecințele juridice ale erorii: anularea contractului și adaptarea contractului.Pe tot parcursul articolului am subliniat progresul cert al noii reglementarii fața de reglementarea precedenta și am particularizat in același timp maniera in care trebuie interpretate acelaeași texte legale in funcție de natura raportului juridic, de drept civil sau nascut in mediul de afaceri (la care participa profesioniștii). Am demonstrat faptul ca și in cazul instituției erorii - viciu de consimțamânt ca și in cazul altor instituții juridice, intr-un monism de reglementare va exista indiscutabil un "dualism" de interpretare.English Abstract: In this article I approached the notion of error – defect affecting the consent having as starting point the recent Romanian legal realities, firstly the entry into force of the Romanian New Civil Code, then the jurisprudence and doctrine trends with respect to the subject matter.I approached the classification of several types of error, then the conditions that a concrete reality of fact should meet in order to be legally qualified, according to the new normative realities, as error – defect affecting the consent. Further, I analysed the cases of error – defect affecting the consent, expressly regulated by the law. In the end, I analysed the legal consequences of the error: the annulment of the contract and the adaptation of the contract.Throughout the entire article I underlined the doubtless progress of the new regulation as compared with the previous regulation and I singularized, in the same time, the manner in which the same legal texts should be interpreted depending on the nature of the legal report, civil or business (to which the professionals participate). I demonstrated that also in case of the concept of error – defect affecting the consent, similarly with other legal concepts, in a monism of regulation undoubtedly exists a “dualism” of interpretation.
