Spanish Abstract: El autor desarrolla una doctrina comprensiva de la antidiscriminacion, basado en el concepto de dignus inter pares, el cual significa que cada persona deba ser merecedora, entre los pares de la fraternidad, de la nacion a la que pertenece, de su dignidad; es la autoestima y la autoestima de pertenecer a un grupo que respeta y aprecia a la persona y que la asistira para poder conservar su dignidad intacta si ello es requerido. La discriminacion es clasificada en diferentes tipos y varios principios son desarrollados para explicar el Derecho Antidiscriminatorio (Legalidad, Gravedad Social, Simbolismo, Diagnostico-Remedio, Adaptacion frente a Situaciones Concretas, Especialidad, Contexto Social y Proteccion de las Libertades Individuales). El mantenimiento de la democracia requiere de politicas antidiscriminatorias solidas. English Abstract: The author develops a comprehensive theory of antidiscrimination, based upon the concept of dignus inter pares, it means, that each person shall be worthy among its peers of its fraternity, of the nation to which it belongs, that is its dignitas; it is the self-esteem and the self-esteem of belonging to a group that respects and appreciates him and that will assist him to keep that dignitas if it is required. Discrimination is classified in different types and several principles are developed to explain Antidiscrimination Law (Legality, Social Gravity, Symbolism, Diagnostic-Remedy, Adaptation to Concrete Situations, Specialty, Social Context and Protection of Individual Freedoms). Maintenance of democracy requires solid antidiscrimination policies.
