Abstract

Данная работа посвящена правовому регулированию защиты прав на товарный знак, анализу международного и отечественного законодательства в данной сфере. Задачи, которые решались в ходе исследования: 1. исследование общей характеристики товарных знаков; 2. исследование процедуры регистрации товарных знаков; 3. уточнение особенностей развития и становления правового регулирования защиты товарных знаков; 4. анализ проблем при применении законодательства о защите товарных знаков; 5. выдвижение предложений по совершенствованию законодательства в области защиты прав на товарный знак. В ходе работы был проведен комплексное исследование правового регулирования защиты прав на товарный знак. Отдельное внимание уделено истории развития правового регулирования товарного знака как в российском законодательстве, так и в законодательстве иностранных государств. Также, проанализированы некоторые изменения, внесенные в законодательство последней реформой гражданского права. Кроме того, в процессе исследования выявлены пробелы в действующем законодательстве, закрепляющем нормы о защите прав на товарный знак.

This work is devoted to the legal regulation of trademark rights protection, analysis of international and domestic legislation in this area. Tasks that were solved during the research: 1. investigation of the general characteristics of trademarks; 2. Investigation of the trademark registration procedure; 3. clarifying the specifics of the development and formation of legal regulation of trademark protection; 4. Analysis of problems in the application of trademark protection legislation; 5. Making proposals to improve legislation in the field of trademark protection. In the course of the work, a comprehensive study of the legal regulation of trademark rights protection was conducted. Special attention is paid to the history of the development of legal regulation of a trademark both in Russian legislation and in the legislation of foreign states. Also, some changes made to the legislation by the latest reform of civil law are analyzed. In addition, the study revealed gaps in the current legislation that enshrines the norms on the protection of trademark rights.
