Abstract

В качестве предмета исследования выступает гражданский контроль в Германии. Целью выпускной квалификационной работы является исследование особенностей системы гражданского контроля Федеративной Республики Германия. В ходе исследования решались следующие задачи: 1. Выявление специфики гражданского контроля в Германии; 2. Определение принципов гражданского контроля в Германии; 3. Анализ деятельности институтов гражданского контроля в Германии; 4. Выявление заинтересованности и включенности граждан Германии в систему общественного контроля. Теоретической базой исследования послужили научные труды российских и зарубежных ученых. В процессе исследования были проанализированы законодательные акты ФРГ: конституция ФРГ, регламент Бундестага, разделы федеральных законов ФРГ об основных правах и Бундестаге; а также результаты социологических опросов населения Германии на тему степени открытости данных, касающихся административных и государственных дел, для граждан страны. При написании выпускной квалификационной работы применялись такие методы исследования, как анализ правовой литературы, обобщение опыта гражданского контроля, классификация видов гражданского контроля в Германии. Результаты выпускной квалификационной работы показывают, что под гражданским контролем понимается деятельность граждан и некоммерческих организаций, направленная на достижение прозрачности работы органов государственной власти и местного самоуправления и повышение эффективности государства. В Германии гражданский контроль развит, а среди граждан страны существует понимание, что он является связующим звеном между гражданским обществом и государством.

The graduate qualification work is devoted to the study of the phenomenon of civil control in Germany. The purpose of the graduate qualification work is to study the features of the civil control system of the Federal Republic of Germany. In accordance with the goal set, the following tasks were solved in the course of the study: 1. Identification of the specifics of civil control in Germany; 2. Definition of the principles of civil control in Germany; 3. Analysis of the activities of civil control institutions in Germany; 4. Identification of the interest and involvement of German citizens in the system of public control. The theoretical basis of the study was the scientific works of Russian and foreign scientists. In the course of the study, the following legislative acts of the Federal Republic of Germany were analyzed: the Constitution of the Federal Republic of Germany, the regulations of the Bundestag, federal laws of the Federal Republic of Germany from the sections on fundamental rights and the Bundestag, as well as the results of sociological surveys of the German population on the degree of openness of data concerning administrative and state affairs to citizens. When writing the graduate qualification work, such research methods as the analysis of legal literature, the generalization of the experience of civil control, the classification of types of civil control in Germany were used. The results of the graduate qualification work show that civil control refers to the activities of citizens and non-profit organizations aimed at achieving transparency in the work of state authorities and local self-government. In Germany, civil control is developed, and there is an understanding among citizens that it is a link between civil society and the state.
