
El presente artículo plantea el inquietante cuestionamiento acerca de una exigencia normativa sobre ‘‘idoneidad moral’’ para la constitución de un tipo específico de empresa: las instituciones financieras. Se parte del análisis de las normativas relativas al Sistema Financiero y el Sistema de Seguro, las que integran bajo sus normas, entre otros, criterios de evaluación tales como el de idoneidad técnica y moral para el representante de una entidad financiera. En el mismo sentido, se analiza el concepto de ‘‘idoneidad moral’’ desde una perspectiva filosófica, Asimismo, de una revisión en Derecho Comparado, se realiza una revisión de legislaciones aplicables. Por último, compartimos una breve reseña de los principios de la moral pública, para finalmente dar una mirada legal a sentencias que han tratado cuestiones sobre idoneidad moral y ética en el Perú.
