Abstract

Zarówno aequitas - instytucja prawa rzymskiego, jak i istishsan (preferencja prawnicza) - instytucja prawa muzułmańskiego odwołują się do pojęcia słuszności. Autorzy artykułu stawiają sobie za zadanie porównanie tych instytucji i udzielenie odpowiedzi na pytanie, czy są to instytucje tożsame oraz zbadanie ewentualnego wpływu jednej instytucji na drugą.
