Abstract

Resume L’article 388-1 du Code civil en France mentionne que « dans toute procedure le concernant, le mineur capable de discernement peut etre entendu par le juge ». Les juges aux affaires familiales ont pour tâche d’evaluer la capacite de discernement du mineur en n’ayant ni definition du discernement ni methode d’evaluation, et en etant sommes de ne pas utiliser le critere de l’âge. A partir des quelques travaux sur le discernement, nous proposons un schema presentant les composants du discernement et les facteurs biopsychosociaux pouvant affecter le discernement d’un choix/avis exprime. L’objectif de cette recherche est d’identifier les elements pris en compte par des juges aux affaires familiales pour apprecier le discernement chez l’enfant et de confronter ces elements a ceux du schema. Trente-deux juges aux affaires familiales ont participe a cette etude. Les juges interroges rapportent certains facteurs identifies dans le schema, d’autres ne sont jamais evoques. D’un point de vue theorique, cette recherche alimente les recherches et les reflexions autour de l’evaluation du discernement. D’un point de vue pratique, cette recherche permet de donner un cadre de reflexion structure aux juges aux affaires familiales vis-a-vis de cette notion de discernement. Cette reflexion pourra egalement servir a d’autres professionnels qui peuvent etre amenes, de facon implicite, a estimer le niveau de discernement, par exemple les enqueteurs sociaux, les avocats et les psychologues.
