Abstract

It is sometimes unproductive to spend too much time on one Family Educational Rights and Privacy Act subject. However, in the case of disclosing education records under the school official/legitimate educational interest exception to written consent, the decision to disclose is strictly subjective. It is based on knowing who your school officials are (listed in your annual FERPA notification) and what constitutes a legitimate educational interest. The former is straightforward; the latter is nebulous.
