Abstract

Hukukipozitivizm hukuk kurallarının ve hukuki işlemlerin normatifliğini açıklayabilirmi? Pozitivist geçerlilik kriterlerine uygunluk bir irade açıklamasının normyaratmasını garanti eder mi? “Normativite ve Pozitivizm” bu iki temel soruyayanıt aramaktadır. Kitap Joseph Raz’ın otorite temelli normativite anlayışındanyola çıkarak hukuk normlarının özel (dışlayıcı) normatif gücünün izini sürer.Meşru otorite kavramı belli şartlara sahip irade açıklamalarının normatifniteliğini hukuki pozitivizmin temel ilkelerine uygun bir biçimdeaçıklayabilir. Bununla birlikte, hukukun meşru otorite tarafından yaratılmadığıdurumlarda normatif nitelik taşımasının koşulları da incelenmelidir. Bunun içinbu çalışmada geçerlilik ve bağlayıcılık kavramlarına ve bu kavramlarınbirbiriyle ilişkisine dair bir tartışma yürütülmektedir. Geçerlilik vebağlayıcılık ilişkisinin doğru bir biçimde kurulması durumunda hukukinormativiteyi açıklayabilen bir pozitivizmin mümkün olduğu savunulmaktadır.
