
Cohabitation as a legal institution in the modern world, characterized by the processes of globalization, integration and free movement of people and capital, is becoming an increasingly common form of family life and requires normative regulation (formalization) of this, by definition, informal phenomenon. This paper analyzes the concept of cohabitation with a brief overview of historical development from Roman and Canon law to modern solutions in national legislation. Special emphasis is placed on the presentation of the legal effects produced by cohabitation, i.e. on comparing normative solutions in the field of family, inheritance, social and tax law. In the final part of the paper, by comparing the legal regulations of cohabitation and analyzing examples from the case law of proving it, proposals are made for improving the legislative framework.
Izvanbračna zajednica kao pravni institut u suvremenom svijetu, kojega karakteriziraju procesi globalizacije, integracije i slobodnog kretanja ljudi i kapitala, postaje sve češći oblik obiteljskog života te iziskuje normativno uređenje (formaliziranje) ovog po temeljnoj definiciji neformalnog fenomena. Ovaj rad analizira pojam izvanbračne zajednice uz kratki prikaz povijesnog razvoja od rimskog i kanonskog prava do suvremenih rješenja nacionalnog zakonodavstva. Poseban naglasak je na prikazu pravnih učinaka koje proizvodi izvanbračna zajednica, odnosno na kompariranju normativnih rješenja u području obiteljskog, nasljednog, socijalnog i poreznog zakona. U završnom dijelu rada, usporedbom zakonske regulative izvanbračne zajednice odnosno analizom primjera iz sudske prakse dokazivanja iste, navode se prijedlozi za unapređenje zakonodavnog okvira.
