Analiza glagolskih kolokacija u engleskom jeziku ugovornog prava

Abstract

Ovaj se rad bavi analizom glagolskih kolokacija u engleskom jeziku pravne struke primjenom korpusnolingvističke i kontrastivne lingvističke analize. Kolokaciju se u ovom radu definira kao tipičnu, pretežito dvodijelnu sintagmatsku svezu koja je uobičajena u engleskom jeziku međunarodnog trgovačkog ugovornog prava i u kojoj postoji semantički hijerarhijski odnos između kolokacijskih sastavnica (Hausmann 1989). Cilj rada bio je utvrditi moguće kolokacijske razlike u engleskom jeziku općih i pojedinačnih pravnih akata, identificirati zakonitosti kojima podliježu kolokacije u jeziku pravne struke te utvrditi može li lingvistička analiza poslužiti kao znanstvena metoda analize pravnog sadržaja pravnih akata. Primjenom kriterija reprezentativnosti, ali i pravnih standarda, za potrebe istraživanja izrađen je engleski jednojezični specijalizirani korpus sastavljen od dva potkorpusa. Primjenom korpusno utemeljenog pristupa, na tim je potkorpusima testirana hipoteza o postojanju razlika između glagolskih kolokatora koji su uz najčestotnije imenične baze potvrđeni u potkorpusu općih akata te u pojedinačnim aktima međunarodnog trgovačkog ugovornog prava. Provedbom detaljne kazuističke analize svakog potkorpusa, utvrđeno je da između zakonodavnih formulacija u općim aktima i prakse u pojedinačnim aktima postoje značajna kolokacijska odstupanja. Uz to, prepoznato je da pojedinačni akti, u pravilu, pokazuju širi raspon kolokacija u odnosu na opće akte, čime se ukazuje na potrebu za prilagodbom ili izmjenom općih akata prema zahtjevima prakse. Navedeno je međutim zasigurno potrebno razmotriti iz perspektive pravne znanosti. Provedena analiza nedvojbeno je pokazala da lingvistika može biti učinkovita metoda za analizu pravnih tekstova, i općih i pojedinačnih. Njezina primjena nadilazi statističku analizu jer pruža uvid i u sadržaj tekstova, pomažući u identifikaciji potrebe za izmjenama regulative, bilo zbog zastarjelosti općih akata ili nedostatka regulacije unutar tih akata. Lingvistika se na taj način može smatrati važnim, objektivnim instrumentom koji je u proučavanju pravnih tekstova komplementaran pravnoj znanosti.

This study investigates verb collocations in English legal language by employing corpus linguistics and contrastive analysis. Collocations are defined here as frequently occurring, typically two-word syntagmatic word combinations characteristic of international commercial contract law and exhibiting a semantic hierarchical relationship between its components (Hausmann, 1989). The aim of this study was to identify potential collocational differences in the English language of general regulations and individual legal documents (contracts), to identify the principles governing legal collocations, and to deterime whether linguistic analysis can serve as a scientific method for analyzing the legal content of legal enactments. A specialized English monolingual corpus, comprising two subcorpora, was compiled for this research based on the criteria of representativeness and adherence to legal standards. A corpus based approach was employed to test the hypothesis that significant differences exist between the verbal collocates associated with the most frequent noun bases in the subcorpora of general regulations and individual legal documents. A detailed case study analysis of each sub-corpus revealed that individual legal documents generally exhibit a broader range of collocations, suggesting a potential need for regulatory adjustments to better reflect practical needs. This, however, requires further consideration and analyses from a legal perspective. This analysis demonstrated that linguistics can be an effective method for analyzing legal texts. Its application extends beyond statistical analysis and provides insights into the content of texts, aiding in the identification of the need for regulatory changes. In this way, linguistics can be considered a valuable, objective tool that complements legal science in the study of legal texts.
