Tijelo kao političko

Abstract

Svrha ovog rada jest istražiti fenomen prostitucije na primjerima regulacije istog te pokazati kako različiti pravni režimi oblikuju tijelo seksualne radnice kroz odnose moći. Polazi se od teorijskog okvira Michela Foucaulta, posebice njegovih koncepata suverene moći, disciplinarne moći, biomoći i guvernmentalnosti, kako bi se analiziralo na koji način zakonodavstvo i javne politike interveniraju u tijelo te ga definiraju kao devijantno, žrtveno ili uvjetno autonomno. Predmet istraživanja čine tri dominantna europska modela regulacije prostitucije: represivni model u Hrvatskoj, penalno-prohibicijski (nordijski) model u Švedskoj i regulatorno-legalistički model u Njemačkoj. Metodološki, rad se temelji na kvalitativnoj komparativnoj analizi zakona, javnih politika i diskursa, uz oslonac na sekundarnu literaturu iz područja političke teorije, feminističkih studija i studija seksualnosti. Rezultati pokazuju da hrvatski represivni okvir održava stigmatizaciju i marginalizaciju prostitutki, švedski model konstruira seksualnu radnicu kao žrtvu i ograničava njezinu autonomiju, dok njemački pristup, iako formalno liberalan, zadržava snažan nadzor kroz administrativne i zdravstvene mehanizme. Zaključuje se da, bez obzira na formalne razlike, svi analizirani modeli reproduciraju odnose moći nad tijelom, a njihova regulacija odražava dublje ukorijenjene društvene vrijednosti, rodne odnose i političke strategije kontrole, čime rad doprinosi razumijevanju prostitucije kao kompleksnog političkog fenomena.
