Abstract

Celem artykułu jest dokonanie analizy niedawnego orzeczenia Trybunału Konstytucyjnego w sprawie dopuszczalności aborcji embriopatologicznej (K1/20) z perspektywy tez głoszonych przez przedstawicieli studiów nad niepełnosprawnością. Projekt ten wydaje się wart realizacji przynajmniej z trzech powodów. Po pierwsze, koncepcje proponowane przez przedstawicieli studiów nad niepełnosprawnością stanowią bardzo ważny wątek współczesnej debaty akademickiej. Po drugie, na gruncie studiów nad niepełnosprawnością wypracowano oryginalne i istotne stanowisko w sprawie aborcji embriopatologicznej. Po trzecie, poglądy przedstawicieli tego nurtu pozostawały dotychczas na marginesie polskiej dyskusji dotyczącej aborcji. Konkluzja przeprowadzonej analizy głosi, że mimo, iż wyrok w sprawie K1/20 może na pierwszy rzut oka jawić się jako zgodny z poglądami przedstawicieli studiów nad niepełnosprawnością, dokładniejsze rozważenie tej kwestii prowadzi do wniosku, że wyrok ten jest dyskryminujący względem osób z niepełnosprawnościami.

The aim of the paper is to analyze the recent judgment of the Constitutional Tribunal in the case concerning disability selective abortion (K1/20) from the perspective of disability studies. The project seems to be worth pursuing three reasons (at least). Firstly, conceptions developed by disability studies constitute an important trend in contemporary academic research. Secondly, this approach offers a unique and important view on the issue of disability selective abortion. Thirdly, in Polish discussions on abortion rights, the ideas proposed by disability studies scholars have not been considered fully. The conclusion of the analysis in the paper is that although the judgment in the case K1/20, at first sight, may seem compatible with the ideas advocated by disability studies scholars, the closer look reveals that the judgment is discriminatory towards people with disabilities.
