Аренда лесного участка в Российской Федерации

Abstract

В статье исследуются правовые вопросы аренды лесных участков, непосредственно связанные с использованием лесного участка в период действия договора аренды. Рассматриваются проблемы, возникающие при предоставлении лесного участка в аренду, в частности постановка участка на кадастровый учет. Описано становления института аренды лесов в России и проведен анализ понятия лесного участка как объекта аренды. Резюмируя изложенное, автор делает вывод о том, что в российском законодательстве не сложилось четкое определение лесного участка и в настоящее время это понятие равнозначно понятию «земельный участок».

The article examines the legal issues lease forest areas directly related to the use of forest land during the term of the lease. The problems that arise in the provision of forest area to rent, in particular staging area for inventory accounting. Described the institute of forest lease in Russia and an analysis of the concept of a forest plot as an object of the lease. Summarizing, the author concludes that the Russian law has not developed a clear definition of forest area and now this concept is equivalent to the concept of «land».
