Некоторые аспекты правового регулирования перехода от технократической к экологической парадигме цивилизации

Abstract

В статье рассмотрен ряд государственно-правовых проблем, подлежащих разрешению для преодоления кризиса и перехода от «серой» технократической к «зеленой» экологической парадигме цивилизации. Антропоцентрический подход подлежит замене экологическим императивом с правовым обеспечением рентабельности охраны природы. Задача права – установить такие условия «аренды» планеты, чтобы человеку было комфортно в меру возможности устойчивого развития ее природного равновесия. Если в глобальном масштабе качественные перемены пока затруднены из-за эгоизма и разобщенности человечества, то, как показывает практика ЕС, весьма успешны локальные экологические программы, осуществляемые развитыми странами на своей территории и частично исправляющие ситуацию у соседей. Украина, развивая свое законодательство и заимствуя достижения Евросоюза, может совместно с единомышленниками участвовать в формировании альтернативной модели развития, синтезируя опыт социалистической экономики, планового хозяйства с актуальными элементами рынка.

A range of the state-legal problems urgent for overcoming of crisis and transition from "grey" technocratic civilisation to "green" ecological paradigm in article considered. The anthropocentric approach is subject to replacement with an ecological imperative with legal maintenance of profitability of environmental management. The aim of the law is to establish conditions of "rent" of a Planet with comfort for mankind within sustainable development of natural balance. While global changes are complicated because of egoism and dissociation of mankind, the EU environmental programs appear quite successful. Ukraine, developing own legislation and borrowing EU achievements, can cooperate with partners in formation of alternative model of development, synthesising experience of socialist economy, a planned economy with actual elements of the market.
