Соглашение о государственно-частном партнерстве: вопросы правовой квалификации

Abstract

В статье рассматривается отраслевая природа соглашения о государственно-частном партнерстве. Автор указывает на отсутствие достаточных оснований для того, чтобы рассматривать данное соглашение как административно-правовой договор. В соответствии с действующим законодательством соглашение о государственно-частном партнерстве предлагается рассматривать как непоименованный гражданско-правовой договор. Отмечается, что правовая квалификация соглашения о государственно-частном партнерстве имеет важное значение для правоприменительной практики. В отношении концессионного соглашения автор присоединяется к позиции, в соответствии с которой данное соглашение предлагается рассматривать как самостоятельный вид гражданско-правового договора. Отмечается, что для эффективной реализации соглашений о государственно-частном партнерстве в федеральном законодательстве необходимо специальное правовое регулирование в отношении заключения, исполнения и прекращения данного вида соглашений.

The article discusses the agreement of public-private partnership from the standpoint of its place in the branches of law. The author notes the lack of substantiation for viewing this agreement as an administrative legal agreement. According to the current legislation on public-private partnership the author offers to view this type of agreement as a civil law contract, which is not referred to in the civil legislation. It is noted that legal qualification of the agreement on public-private partnership is important for the legal practice. As to the concession agreement, the author joins the position according to which this agreement should be regarded as an independent type of civil law contract. It is noted that for the efficient implementation of the public-private partnership agreement in the federal legislation, there is need for specialized legal regulation on conclusion, performance and termination of this type of agreements.
