ТРУДОВЫЕ ДОГОВОРЫ НА ЗАМЕЩЕНИЕ ДОЛЖНОСТЕЙ НАУЧНО-ПЕДАГОГИЧЕСКИХ РАБОТНИКОВ В ОБРАЗОВАТЕЛЬНОЙ ОРГАНИЗАЦИИ ВЫСШЕГО ОБРАЗОВАНИЯ

Abstract

The paper analyzes the features of employment contract conclusion with the teaching staff. It justifies the need to consider specific differentiation standards of legal regulation of university professors’ labour. Possible solutions for the problems under investigation are suggested. Analysis of the Chapter 52 of the LC RF shows that the principle of equality of workers of different categories is not always observed in the restatement of law. It is concluded that further development of Labor Law should be carried out with the observance of general employment and labour statutes as well as with the provision of guarantees for the teaching staff that meet the requirements of time.

Анализируются особенности заключения трудового договора с педагогическими работниками. Обосновывается необходимость рассмотрения конкретных норм дифференциации правового регулирования труда преподавателей вузов, предлагаются возможные решения исследуемых проблем. Анализ главы 52 ТК РФ позволяет утверждать, что в изложении норм не всегда прослеживается принцип равенства работников различных категорий. Делается вывод о том, что развитие трудового законодательства в дальнейшем должно осуществляться по пути соблюдения общих норм трудового права, а также установления гарантий для педагогических работников, соответствующих требованиям времени.
