Inferencia epistémica y argumentación

Abstract

El artículo analiza el desempeño argumentativo del concepto jurídico procesal de máxima de la experiencia. Partiendo de la propuesta teórica de Toulmin, se ensayan diversas estrategias argumentativas para refutar máximas de la experiencia que integren inferencias epistémicas. Estas objeciones pueden dirigirse: contra el respaldo, contra la relación entre el respaldo y la máxima de la experiencia, contra la máxima de la experiencia, y contra la relación entre la máxima de la experiencia y el hecho probatorio​. El elenco de posibilidades no es ni exhaustivo, ni excluyente, y sólo contempla objeciones dirigidas a máximas de la experiencia analizadas de forma individual, esto es, sin escudriñar las posibilidades de argumentación derivadas de la interacción entre inferencias epistémicas en el discurso probatorio. Se pretende, de esta manera, dotar de herramientas que fortalezcan la argumentación de los operadores jurídicos en discusiones acerca de si se encuentra probado (o no) un hecho con relevancia jurídica.
