Abstract

La presentación busca analizar los pasos que hicieron posible el Plan de Proyecto Humanitario I y II como caso ejemplar para la diplomacia al servicio de objetivos humanitarios, resaltando el valor del Derecho Internacional Humanitario después del cese de las hostilidades en los conflictos armados. Para ello se interroga sobre ¿cómo es que el derecho de las y los familiares toma el primer lugar en la relación de dos países con disputas aún vigentes, logrando superponerlo a todo y atendiendo a sus obligaciones legales de hacer todo lo posible por identificar a quienes, desde siempre, tuvieron nombre y apellido? Para abordarlo, se realizó una revisión de fuentes disponibles en la web del Comité Internacional de la Cruz Roja (CICR) y la revista de esta institución; normativa alusiva al Derecho Humanitario Internacional; fuentes gubernamentales de la República Argentina; y el testimonio del asesor legal regional del CICR, Dr. Valladares, al igual que sus registros escritos sobre el primero de los planes; entre otras. Se concluye sobre la experiencia única que constituyen los Planes de Proyectos Humanitarios I y II dentro de la implementación de los deberes de las Partes beligerantes a nivel internacional.
