Abstract

The aim of the study was to find causal links between the appearance of the encomienda in 1503 and the need for the adoption of the laws of Burgos in 1512 in the light of the internal struggle of the Spanish Crown ("House of Trastamar") against the" House of Columbus", as well as the confrontation of the Franciscan Order with the Dominican Order in the New World. The author studied events in different parts of the world, studied primary sources and their translations, as well as scientific articles by Russian, American, French, English and Spanish authors. The research uses the system method, the comparative-historical method, the content analysis methods, and the chronological method. The article concludes that the need to convene the Burgos junta in 1512 stems from the need to settle the legal framework between the Spanish settlers and the natives of the West Indies, which was introduced with the encomienda system in 1503 by Nicholas Ovando, and the convocation of the Burgos junta was necessary for the political blow of the "House of Trastamar" against the House of Columbus. It is concluded that King Ferdinand II of Aragon used the complaints of the Dominican monks about bad management of Diego Columbus for his political purposes, but this led to the adoption in 1512 of the most humane laws of the time, which we can call the progenitors of "human rights". Целью исследования было обнаружение причинно-следственных связей между появлением энкомьенды в 1503 году и необходимостью принятия Законов Бургоса 1512 года в свете внутренней борьбы испанской короны («Дома Трастамара») против «Дома Колумбов», а также противостояния Францисканского Ордена с Орденом Доминиканцев в Новом Свете. При написании статьи были исследованы события в разных частях мира, изучены первоисточники и их переводы, научные статьи русских, американских, французских, английских и испанских авторов. При исследовании использованы системный метод, сравнительно-исторический метод, методы контент-анализа, хронологический метод. В статье сделаны выводы о том, что необходимость созыва Хунты Бургоса 1512 года для принятия новых законов, проистекает из необходимости урегулирования правовой базы, между испанскими поселенцами и аборигенами в Вест-Индии, которая была введена с системой энкомьенды в 1503 году Николасом Овандо. Также созыв Хунты Бургоса был необходим для нанесения политического и юридического удара «Дома Трастамара» по «Дому Колумбов» в споре за контролем над поступающими доходами из Вест-Индии в рамках идущего судебного противостояния между королем Фердинандом II Арагонским и «Домом Колумбов».
