Abstract

El derecho penal es el encargado de regular la tipificación de las infracciones penales, las penas y las medidas de reparación integral que tienen que realizar aquellas personas que han incumplido con su deber objetivo de cuidado, es decir, establece las normas y los procedimientos que se utilizan para sancionar a los individuos que han cometido algún delito o contravención, para de esa manera proteger a la sociedad de conductas dañinas y peligrosas, y en ese mismo sentido se protege a la naturaleza como sujeto de derecho de acuerdo a la Constitución ecuatoriana, para lo cual, se han establecido penas que van desde multas económicas hasta privación de la libertad para quienes actúen en perjuicio del medio ambiente, mismas que se hallan contenidas en el Código Orgánico Integral Penal, en tal sentido, es muy importante conocer cuáles son las medidas coercitivas penales que existen en el Ecuador para proteger el ambiente y mitigar los impactos negativos que ha sufrido la naturaleza. En la investigación se asume un enfoque neutrosófico y una investigación de mixta cuali-cuantitativa, afirmada bajo los tipos de investigación descriptiva. Es por ello que el objetivo de presente trabajo es: realizar un análisis estadístico neutrosófico sobre el conocimiento de los estudiantes sobre infracciones penales como medios coercitivos para la protección del medio ambiente. Donde los resultados mostraron un alto nivel de validez de la presente investigación.
