Informe jurídico sobre el régimen especial del aceite de cocina usado como bien priorizado

Abstract

Como parte de la iniciativa de la Clínica de Litigación Ambiental Científica (CLAC), se ha realizado el presente informe jurídico sobre el tratamiento de los Aceites de Cocina Usado (ACU), dado que representan un peligro para el medio ambiente, especialmente para el agua, puesto que 1 litro de aceite puede contaminar hasta 40 mil litros de agua, esto debido a que son desechados directamente en las cañerías. Por ello, el informe busca analizar en primer lugar, la regulación nacional con respecto a los ACU, desde el Decreto Legislativo N°1278, Ley de Gestión Integral de Residuos Sólidos, así como también su reglamento que fue aprobado por el Decreto Supremo N° 014-2017, ello para determinar si los ACU cumplen con las características para ser considerados como bien priorizado. Por otro lado, también se analiza la Norma Técnica Peruana 900.050:2022, la cual precisa lineamientos para el manejo adecuado de aceites usados, pero solo se enfoca en los aceites lubricantes, mas no en aceite vegetal o animal. Así pues, se demuestra que la normativa actual respecto a ACU es insuficiente. Para luego, dar una mirada a las normativas que han establecido países como España, Colombia y Argentina, en lo concerniente a la gestión de los Aceites de Cocina Usado y como lo han regulado estos para lograr una adecuada gestión. Todo ello, con la finalidad de contar con los recursos necesarios para la creación de un Régimen Especial de Aceite de Cocina Usado como Bien Priorizado, y así sacar provecho al potencial en materia prima que tiene este residuo, ya sea mediante la valorización material o energética.
