A MEDIAÇÃO COMO INSTRUMENTO JURÍDICO DE INIBIÇÃO DOS IMPACTOS NEGATIVOS À MENORES EM DIVÓRCIOS LITIGIOSOS

Abstract

O presente artigo científico, em um primeiro momento, efetua o estudo da crise do Poder Judiciário brasileiro, bem como a apresentação das possíveis soluções que as vias conciliativas podem trazer (em especial a mediação), para sanar as múltiplas deficiências e inconsistências da jurisdição estatal. Posteriormente, é retratada a essência deste trabalho, especificamente se busca compreender a utilização do instituto da mediação no sentido de se oferecer decisões consensuadas e não degradantes para divórcios litigiosos contemplando menores, de modo a garantir a estabilidade familiar. O Direito Comparado também é explorado em virtude de uma maior abrangência da pesquisa. Por fim, é realizada uma série de considerações sobre a temática sob análise, com base nas informações trazidas e os fundamentos legais intrínsecos à ordem jurídica pátria, com enfoque na Lex Legum brasileira (Constituição Federal).
